The continuation of Australian Fisheries Healthcheck has been supported by the Fisheries Research and Development Corporation (FRDC) on behalf of the Australian Government (Project 2023-024) and the DAFF Ag Traceability Uplift – Responsible fisheries – Activating a comprehensive Ecological, Social, and Governance (ESG) reporting data system to uplift sustainability traceability. Step 1: Search for any data regarding fishery worker visa status (e.g. in reports). Search for data regarding sharefishing arrangements made with the fishery. If all workers are known to hold permanent visas (WTV ❌) and it is known that no sharefishing arrangements are in place (SF ❌), assume that the 2009 Fair Work Act applies and that there is no potential for vulnerable workers. Report "Workers protected" and the date of data provenance and/or publication of the information that states that there are no workers with temporary visas or sharefishing arrangements. Step 2: If any workers are known to be temporary visa holders (WTV ✅) or there is no available information regarding worker visa status (WTV ?) at the time of data collection for the framework, search for reference to Fishing Industry Labour Agreements. Options: Fishing Industry Labour Agreements apply to the fishery (WTV 🛡️), they are known to not apply (WTV ⚠️), or no information is found for the fishery (WTV ❓). If any sharefishing arrangements are known to exist with the fishery (SF ✅), or there is no available information regarding the Presence/absence of sharefishing arrangements (SF ?) at the time of data collection for the framework, search for formal agreements made around sharefishing that contain explicit provisions protecting workers. Options: Formal agreements protecting workers in sharefishing arrangements exist (SF 🛡️), they are known to not exist (SF ⚠️), or no information is found for the fishery (SF ❓). Step 3: Report either "Workers protected", "Potential vulnerable workers", or "Vulnerable workers" using the following decision rules: - WTV 🛡️ and SF 🛡️: "Workers protected" - WTV ✅ and WTV ⚠️: "Vulnerable workers" - SF ✅ and SF ⚠️: "Vulnerable workers" - (WTV ✅ or WTV ?) and WTV ❓: "Potential vulnerable workers" - (SF ✅ or SF ?) and SF ❓: "Potential vulnerable workers"
